These Terms govern your use of heyrocky.com and services offered by Rocky Ventures LLC, doing business as Rocky ("Rocky," "we," "us"). By using the site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.
1. What we do
Rocky helps consumers learn about debt relief options and connects eligible consumers with Alleviate Financial Solutions LLC, which negotiates with creditors on enrolled accounts. Submitting information on this site does not enroll you in any program. Any enrollment happens only through a separate written agreement that describes the program, its fees and its risks.
We are not a lender and do not make loans. We are not a credit repair organization, law firm or tax advisor, and nothing on this site is legal, tax or financial advice.
2. Eligibility
You must be at least 18, a U.S. resident in a state where our services are offered, and providing information about your own debts. You agree that the information you give is true and complete.
3. No guarantees
We do not guarantee that any debt will be settled, reduced or eliminated, or any specific savings or timeline. Not all debts qualify. Creditors are not required to negotiate. Results depend on your creditors, your balances and your ability to save and make program payments. Testimonials and examples reflect individual experiences and are not typical or guaranteed results.
4. Program risks you should understand
If you enroll in a debt settlement program:
- You will generally stop paying creditors directly while you save funds, which can hurt your credit score and lead to late fees, added interest, collection calls and lawsuits
- Programs typically take 24 to 48 months, and you may not complete the program
- Settled or forgiven debt may be taxable income; consult a tax professional
- Fees are charged only after a debt is settled, you have agreed to the settlement, and at least one payment has been made to the creditor, as required by the FTC Telemarketing Sales Rule
- Funds you save are held in an account in your name that you own and can withdraw at any time
5. Credit authorization
If you authorize a credit inquiry, you allow us to obtain your credit profile through Spinwheel Solutions, Inc. and use it only to evaluate your debts and eligibility, as described in the authorization you accept and our Privacy Policy. This is a soft inquiry and does not affect your credit score. You can revoke it at any time by emailing privacy@heyrocky.com.
6. Calls and text messages
By giving consent, you agree to receive calls and texts, including automated and prerecorded messages, at the number you provided. Consent is not required to buy anything. Message frequency varies; msg and data rates may apply. Reply STOP to cancel and HELP for help. You confirm you are the subscriber or regular user of that number and will tell us if it changes. Calls may be recorded.
7. Acceptable use
You agree not to submit someone else's information, use bots or automated means to access the site, interfere with its operation, or copy its content for commercial use.
8. Intellectual property
The site, the Rocky name and likeness, logos and content belong to Rocky Ventures LLC or its licensors and may not be used without permission.
9. Disclaimers
The site is provided "as is" and "as available." To the extent allowed by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
10. Limitation of liability
To the extent allowed by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the site. Our total liability for any claim related to the site will not exceed $100. Some states do not allow these limits, so they may not apply to you.
11. Arbitration and class action waiver
Please read carefully. Any dispute between you and us about the site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court, except that either party may bring an individual claim in small claims court. You waive the right to a jury trial and to take part in a class or representative action. You may opt out of this section within 30 days of first using the site by emailing support@heyrocky.com with your name, phone number and the words "arbitration opt out."
12. Governing law
These Terms are governed by the laws of the State of Florida and applicable federal law, including the Federal Arbitration Act.
13. Changes
We may update these Terms and will post the new date at the top of this page. Continued use means you accept the updated Terms.
